9/11 AND ANTI-TERRORISM: BUILDING CASES BLOCK BY BLOCK

In a major new development for international terrorism litigation, Ron Motley recently won a forum non conveniens victory in the Taba Hilton case, where he convinced a Miami Court to rule from the bench at oral argument that defendant Hilton Hotels Corporation must stand trial in the United States against both U.S. and non-U.S. plaintiffs for events arising out of a terrorist attack in Egypt. On the 9/11 front, Ron is scheduled to try the first 9/11 aviation liability case starting in November 2007 against airlines and security companies who failed to implement basic security measures, enabling the terrorists to launch the September 11th attacks. Beyond the multiple 9/11 aviation liability cases set for trial, in recent months Ron’s team has successfully settled several 9/11 aviation cases, shattering a 50-year old settlement matrix forged by New York aviation firms. And on yet another front, critical depositions are now underway in the 9/11 terrorism MDL against financial sponsors of al Qaeda, five years of motions and three federal judges later.

The significance of insurance as an asset in tort, financial fraud and other claims is often overlooked or is realized too late by plaintiffs and, in many cases, by policyholder defendants. It is not hyperbole to say that over the years, hundreds of millions, if not billions, of dollars have been left on the insurer table as a result. Issues for discussion include: triggering different coverages as well as different policies; when coverage is unlimited; how the pleading and defense of a claim can determine the availability and amount of insurance as well as the strategic alignment of insurers and the parties; distinguishing among insurers and their mutually conflicting interests; the impact of prior insurance releases; valuing financially weak, insolvent or missing coverages; when plaintiffs stand in the policyholder’s shoes; tailoring settlements to insurers; and how the unseen reinsurers dramatically affect the process.
